Misdemeanor Theft
Petty Theft/Larceny is the theft of any good or a service valued at $200 or less, and is punishable by up to more than 90 days in jail and a fine of up to $500.
Second-Degree Theft is the theft of any goods or services valued between $200 and $1000, and is punishable by up to one full year in jail as well as a significant fine of either $2000 or three times the value of the stolen item, whichever is more.
Felony Theft
Basic Felony Theft covers all felony theft charges for goods or services valued between $1000 and $20,000, and carries criminal penalties of fines and jail time. Felony theft offenders may face up to five years is prison and be responsible to paying a fine of up to $10,000, or three times the value of the stolen goods or services.
Second-Degree Felony Theft refers to the theft of any services or goods valued at more than $20,000. Offenders are likely to face as many as 10 years in prison as well as up to $15,000 in fines, or three times the stolen property’s value.
Prior Convictions
Prior theft convictions on your record can significantly affect your charges and sentencing. In most cases, your charges will be bumped up to the next tier, meaning even if you are picked up for stealing less than $200 worth of goods, if it is your second or third arrest you may face second-degree theft charges.
