Marijuana

As more and more states continue to embrace the medical and recreational use of marijuana, the stigmas surrounding it continue to fade into our nation’s history. However, just because medical marijuana has been around in Michigan for some time already and recreational use officially became law December 6th, 2018, doesn’t mean that there aren’t still laws and regulations in place to protect everyone. For example, in order to prevent minors from being influenced by the substance in any way, consumption of any form of cannabis in any public place is still extraordinarily illegal. In order to avoid facing penalties for marijuana related offenses, adhering to specific laws regarding possession and home storage is extremely important, for instance:

Medical Marijuana Law

Medical marijuana has been legal in the state on Michigan since 2008 after 63% of voters approved Proposal 1 in November of that year. Local law regarding medical marijuana dictates that all officially “registered patients can possess up to 2.5 ounces of ‘usable marijuana,’ or up to 12 marijuana plants in an enclosed, locked facility.”

Recreational Marijuana Law

The Marijuana Legalization Initiative paved the way in Nov-Dec of 2018 for recreational marijuana users 21 year of age and older to be able to buy up to “2.5 ounces of marijuana, and keep up to 10 ounces at home.” However, “any amounts over 2.5 ounces must be secured in locked containers. Adults can also grow up to 12 cannabis plants for personal use.”

Possession of any quantities of cannabis exceeding legal limits, the unlawful sale of cannabis, and other related offenses are still considered very serious in Michigan, which is why it is important for people to be aware of and actually obey the laws put in place surrounding medical and recreational marijuana use. However, if you have been charged with any type of marijuana related crime, our attorneys at Fraiberg & Pernie, PLLC can still help you.
